Terms of Service

Last Updated: 11/3/2026

1. Acceptance of Terms

By accessing, browsing, or utilizing the Novicite software platform, APIs, dashboard, or client-side telemetry scripts (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Authorized Use & Commercial License

Subject to these Terms, Novicite grants you a limited, non-exclusive, non-transferable, revocable license to use the platform for internal business analysis, Generative Engine Optimization (GEO), AI crawler telemetry monitoring, and client reporting.

You agree that you shall NOT:

  • Use the Service for any unlawful, defamatory, harassing, or deceptive purpose.
  • Deploy automated astroturfing, malicious RAG-poisoning, black-hat reputation manipulation, or artificial review spamming that violates third-party search engine or LLM guidelines.
  • Attempt to reverse-engineer, decompile, disassemble, or extract source code from any proprietary algorithms of Novicite.
  • Resell, sublicense, or rent access to Novicite without an authorized Enterprise/Agency license.

3. Generative Engine Optimization (GEO) & AI Output Disclaimer

Novicite provides analytical intelligence, telemetry tracking, and structured schema generators intended to optimize domain discovery across third-party artificial intelligence engines (including, but not limited to, OpenAI ChatGPT, Anthropic Claude, Perplexity AI, Google AI Overviews, and Microsoft Copilot). Novicite does NOT guarantee specific search rankings, citation inclusion, or conversion outcomes. Third-party LLM algorithms, crawling intervals, and inference models evolve independently and are beyond the control of Novicite.

4. Comparative Benchmarks & Trademark Fair Use

All third-party product names, company names, trademarks, logos, and brands referenced within Novicite (including competitor comparison decks and share-of-voice monitors) are the property of their respective owners. Reference to any third-party entity or trademark is strictly for informational, benchmarking, and nominative fair-use purposes, and does not imply endorsement, affiliation, or sponsorship.

5. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall Novicite, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or business interruption) arising out of or related to your use of the Service.

You agree to defend, indemnify, and hold harmless Novicite and its affiliates from and against any claims, liabilities, damages, judgments, or expenses arising from your violation of these Terms or your misuse of the platform.

6. Contact & Governing Law

These Terms shall be governed by and construed in accordance with applicable commercial laws. For any legal inquiries regarding these Terms, please contact legal@novicite.com.
